Submission and Moderation of Educational Resources
Acacurs is a collaborative platform dedicated to sharing educational resources. Any user may submit documents (lessons, exercises, revision sheets, exams, etc.) to make them accessible to the community. Submitted documents are manually reviewed by the Acacurs team before publication. Approved documents become publicly accessible to all platform users. Rejected documents are not published; the user is notified and may submit a revised version. Acacurs reserves the right to remove any content that does not comply with its editorial guidelines or these terms of use, without prior notice.
Your Contributions and Suggestions
Any comments, ideas, suggestions, or improvements you send us regarding the platform or its content remain the exclusive property of Acacurs, unless otherwise explicitly agreed. We may freely use these contributions to improve our services, with no obligation of compensation. By submitting an educational resource, you declare that you are the author or hold the necessary rights for its distribution, and you grant Acacurs a non-exclusive license to store, display, and make it available to platform users.
Your Consent
By creating an account on Acacurs, using the platform, or submitting educational resources, you expressly accept these terms of use and our privacy policy. If you are a minor, your use of the platform implies the consent of your parent or legal guardian. Acacurs is intended primarily for students and education professionals. We encourage parents and legal guardians to accompany minors in their use of the platform and to review the resources accessed.
Links to Third-Party Websites
Some resources or pages on Acacurs may contain links to external websites that we do not manage. These links are provided for informational purposes only. We recommend that you review the terms of use and privacy policy of each third-party site you visit. Acacurs assumes no responsibility for the content, reliability, or practices of these external sites.
Cookies and Browsing Data
Acacurs uses cookies to improve your experience on the platform: remembering your login session, saving your language preferences, and anonymously tracking navigation to improve the service. These cookies do not collect any personally identifiable data. You may configure your browser to refuse cookies, but certain platform features — including access to your personal space and resource downloads — may no longer function properly. By continuing to browse Acacurs, you consent to the use of cookies as described above.
Changes to Our Terms & Conditions
Acacurs reserves the right to modify these terms of use at any time, particularly to adapt to platform developments or applicable regulations. In the event of a substantial change, users will be notified via the platform or by email at least 15 days before the new terms take effect. By continuing to use Acacurs after that date, you accept the updated terms. If you refuse these changes, you may delete your account at any time.
Platform Evolution
Acacurs is a continuously improving platform. We reserve the right to modify, enhance, suspend, or discontinue all or part of the platform's features — including access to certain educational resources — at any time and without notice, including for maintenance, updates, or technical constraints, without incurring any liability toward users.
Platform Updates
We continually work to improve Acacurs. Updates may be deployed regularly to fix bugs, improve performance, enhance resource sharing and downloading features, or strengthen platform security. These updates are an integral part of the service and are subject to these terms. No obligation to provide a specific update or maintain any particular feature is guaranteed.
Third-Party Services and Content
Acacurs may integrate or reference tools, services, or content provided by third parties (file hosting, document readers, analytics services, etc.). The use of these third-party services is subject to their own terms and conditions and privacy policies. Acacurs is not responsible for their availability, accuracy, or compliance with applicable laws. We recommend that you review the terms of these services before using them.
Term and Termination
These terms of use remain in effect for as long as you use the Acacurs platform. You may terminate your account at any time from your profile settings. Acacurs reserves the right to suspend or delete any account in the event of a violation of these terms — including publishing non-compliant content, attempting to circumvent the moderation system, or abusing the platform — without notice and without compensation. Termination of your account results in the removal of your access to the platform, but resources you have published and had approved may remain accessible to other users unless you explicitly request their deletion.
Copyright Infringement Notice
Acacurs respects intellectual property. If you believe that a resource published on the platform infringes your copyright, please contact us providing: (a) your full contact details (name, address, email, phone); (b) the precise identification of the resource in question and its URL on the platform; (c) a description of the protected work you own; (d) a statement made in good faith that the reported use is not authorized; (e) a declaration of the accuracy of the information provided. We will process your report as soon as possible and remove the content if the infringement is confirmed.
User Responsibility
By using Acacurs, you agree to take full responsibility for the resources you publish and your actions on the platform. You agree to indemnify Acacurs, its collaborators, and partners against any claim, complaint, or damage resulting from: (a) a violation of these terms of use; (b) the publication of content that infringes the rights of a third party (copyright, privacy, etc.); (c) fraudulent or abusive use of the platform.
No Warranty on Content
The educational resources available on Acacurs are shared by users and provided 'as is'. Although we conduct a manual review before publication, Acacurs does not guarantee the accuracy, completeness, timeliness, or pedagogical compliance of the content available on the platform. It is the responsibility of each user to assess the relevance of downloaded resources before using them for learning or teaching purposes.
Acacurs does not guarantee uninterrupted access to the platform or the permanent availability of all resources. Temporary interruptions may occur for maintenance or update reasons. We cannot be held responsible for any data loss, temporary inaccessibility, or any other technical malfunction beyond our control.
Limitation of Liability
To the extent permitted by applicable law, Acacurs shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the platform, the loss or inaccuracy of educational resources, or any decision made based on the available content. Acacurs's total liability toward a user is, in any event, limited to the amount possibly paid by that user to access the platform's paid services, if applicable.
Severability
If any provision of these terms of use is found to be invalid or unenforceable by a competent court, it will be modified to the minimum extent necessary to make it enforceable, without affecting the validity of the other provisions, which will remain in full force and effect.
These terms, combined with our privacy policy, constitute the entire agreement between you and Acacurs regarding the use of the platform. Any legal action related to the use of Acacurs must be initiated within one (1) year from the occurrence of the triggering event, failing which it will be time-barred.
Waiver
The failure of Acacurs to exercise a right or to require the performance of an obligation set out in these terms shall not constitute a definitive waiver of that right or obligation. Any waiver must be expressly stated in writing to be valid.
No failure to exercise a right under these terms constitutes a waiver of that right for the future. In the event of a conflict between these terms and any other provision applicable to a specific platform feature, these terms shall prevail.
Amendments to This Agreement
Acacurs reserves the right to modify these terms of use at any time. In the event of a significant change, we will notify you with at least 30 days' notice via the platform or by email. By continuing to use Acacurs after the new terms take effect, you tacitly accept them. Otherwise, you have the option to delete your account.
Entire Agreement
These terms of use, together with Acacurs's privacy policy, constitute the entire agreement between you and us regarding the use of the platform. They supersede any prior agreement, oral or written, on the same subject. Additional terms may apply to certain specific features or services of the platform; these will be communicated to you at the time of their activation.
Updates to Our Terms
We may update these terms to reflect new features on Acacurs, legal developments, or feedback from our user community. We will inform you of any significant changes via the platform, and you will have the opportunity to review the new terms before they take effect. If you continue to use Acacurs after that date, you accept the updated terms. If you do not wish to accept them, you may delete your account at any time.
Intellectual Property
The Acacurs platform, its interface, logo, name, visual identity, and all its components are the exclusive property of Acacurs and are protected by Nigerien and international laws relating to copyright and intellectual property. Educational resources published by users remain the property of their respective authors. By submitting them on Acacurs, users grant the platform a non-exclusive license to display and distribute them to other users, strictly for educational purposes. Any reproduction, modification, or commercial exploitation without prior authorization is prohibited.
Dispute Resolution
In the event of a dispute relating to the use of Acacurs, the parties agree to first seek an amicable resolution. This clause applies to any dispute related to the use of the platform, published resources, the terms of use, or the privacy policy, with the exception of disputes relating to the protection of intellectual property rights, which may be subject to direct legal proceedings.
Notice of Dispute
Before initiating any proceedings, the party wishing to submit a dispute must send a written notice to the other party, specifying: their identity and contact details, the nature of the dispute, the facts involved, and the desired resolution. This notice must be sent by email to: info.acacurs@gmail.com. The parties agree to attempt to resolve the dispute amicably within sixty (60) days of receiving this notice. If no agreement is reached, any subsequent proceedings will be initiated in accordance with the law applicable in Niger.
Arbitration
If the dispute cannot be resolved amicably within the allotted time, the parties agree to submit to arbitration. The arbitration proceedings will be conducted in accordance with the rules in force and will be held in the French language. Each party bears its own costs related to the proceedings, unless the arbitrator decides otherwise. Any party may seek interim or provisional relief from a competent court, if necessary to preserve its rights pending the outcome of the proceedings.
Submissions and Associated Rights
By submitting an educational resource on Acacurs, you represent and warrant that: (a) you are the author of the document or hold the necessary rights for its public distribution; (b) the document does not contain any illegal, offensive content or content that infringes the rights of a third party. You grant Acacurs a non-exclusive, royalty-free, worldwide license to host, display, index, and make this content available to platform users, strictly within an educational framework. Submitted documents are manually reviewed by the Acacurs team. Approved documents become publicly accessible. Rejected documents are not published and the user is notified.
Events and Promotions
Acacurs may occasionally organize events, educational challenges, contests, or promotions involving users. These activities will be governed by specific rules that will set out eligibility conditions, participation terms, and any rewards. It is your responsibility to carefully read these rules before participating. By participating, you agree to comply with them. Additional terms may apply and will be incorporated into these terms by reference.
Display or Information Errors
Despite our efforts to ensure the accuracy of information displayed on Acacurs, typographical errors or inaccuracies may occur. In the event of an error in the description of a resource, service, or price, we reserve the right to correct this information without prior notice. If a transaction has been carried out based on incorrect information, we commit to contacting the user concerned and offering them an appropriate solution.
Miscellaneous
These terms are governed by Nigerien law. Acacurs operates and administers its platform from Niger. If you access Acacurs from another country, you are responsible for complying with applicable local laws. If any provision of these terms is declared invalid, it does not affect the validity of the other provisions. Section headings are provided for reference only and have no legal value. No modification of these terms may be made by the user. In the event of a discrepancy between a translated version of these terms and the original French version, the French version shall prevail.
